1. The Three Tiers of AI Visual Assets

Tier 1: Fully Synthetic Personas & Avatars (Mandatory Disclosure)

AI-generated human models representing products, clothing, or lifestyle scenarios. Must include a clear disclosure label stating the person is artificially generated.

Tier 2: AI Environment & Background Generation (Context Dependent)

Placing real products inside AI-generated environments (e.g. synthetic luxury villas or futuristic cities). Disclosure required if it misleads consumers regarding product origin or actual setting.

Tier 3: Assistive Retouching & Generative Fill (Exempt)

Compliance requires that disclosure is clearly visible, legible, and unambiguous at the moment the consumer views the media:

  • On-Image Overlay: A small, legible text overlay in a corner (e.g., "AI-Generated Image").
  • Social Media Caption: Including an explicit disclosure statement in the top 2 lines of post text.
  • Metadata Tags: Embedding C2PA digital watermarks or IPTC metadata into the image file header.
